Subject: Article 1 - paragraph 134 - Law No. 234/2021: Stabilization of mandatory and optional paternity leave
The Inps Circular No. 1 of 03/01/2022 intervenes on paternity leave (mandatory and optional) that Law No. 234/2021 (so-called Budget Law) stabilized to take effect from 2022.
The following is a summary of its essential features.
In line with what is already provided, for children born, adopted or fostered on or after 01/01/2022, the employed father is entitled to benefit:
Of optional leave of one day, the use of which is made "by agreement with the mother and in her place, in relation to the period of compulsory abstention due to the latter."
A mandatory leave of 10 days. Also to be enjoyed continuously.
The leave-both mandatory and optional-is usable within the fifth month following the child's birth (or the child's entry into the family or entry into Italy, if the adoption is international in nature).
This term will also apply in case of premature birth.
It is also noted that the Budget Law, in Paragraph 25, extends the enjoyment of mandatory and optional paternity leave to cases of perinatal death.
