Subject: Obligation to send equal opportunity prospectus for men and women extended to companies with more than 50 employees - online-only fulfillment
Law No. 162/2021 made amendments to Legislative Decree No. 198/2006 (Equal Opportunity Code) and introduced other provisions on equal opportunities for men and women in employment.
The requirement to submit the biennial equal opportunity report for men and women concerns all companies with more than 50 employees (previously the threshold concerned companies with more than 100 employees), leaving even companies with fewer than 50 employees the option, in any case, to submit the biennial report, in order for them too to be able to participate in the certification procedure, which would allow virtuous companies to access contribution benefits and other bonus institutions related to calls for tenders for European funds or for the awarding of contracts, as already provided for funds granted to NRPs (National Recovery and Resilience Plans).
Companies obligated with more than 50 employees, and companies with up to 50 employees (which can also optionally submit the prospectus) that have never submitted the biennial equal opportunity report, will need to refer to the status of their personnel in force as of 12/31/2019 (with biennium of reference: 2018/2019).
Companies with more than 100 employees, will need to refer to the status of personnel in force as of 12/31/2021 (with biennium reference: 2020/2021).
The procedure for filling out the prospectus and sending it to the Ministry of Labor and Social Policy is exclusively telematic, and is accessed only with SPID or CIE.
The prospectus submission deadline is April 30, 2022.
