On the night of July 29-30, 2020, the Council of Ministers approved a state of emergency to counter and contain the epidemiological risk from covid-19 until the end of October 15, 2020.
Among the various measures that will be adopted and/or extended as a result is smart working, which is the mode of conducting work outside the employer's premises.
Our legislature since the Dpcm of Feb. 25 had allowed, as well as recommended by subsequent decrees, to adopt the smart working mode even in the absence of the individual agreements provided for in Law No. 81/2017, with only compliance with health and safety information to the workers involved.
In the face of the extension of the state of emergency, companies that as a measure of prevention and containment of coronavirus infection have decided to adopt this working mode (for activities for which remote work can be carried out) may continue to adopt the simplified measure even in the absence of the individual agreements, following the simplified mode as well as the rules until now provided for.
Specifically, it will be necessary to make this known to the Ministry of Labor and Social Policy through the inclusion on the dedicated site of a template in excel format, from which the names of the employees concerned and some other fundamental information will result, such as we recall in particular the territorial insurance position associated with each employee.
