Subject: News Ministry of Labor No. 9/2023 containing "initial indications" on the changes made to the fixed-term contract by Decree Law No. 48/2023.
As is well known, Art. 24 of Decree Law 48/2023 (so-called Labor Decree, a decree converted with amendments by Law No. 85/2023) amended the regulations on fixed-term subordinate employment contracts.
Several months later, the Ministry of Labor has issued the long-awaited explanatory circular (No. 9 of 09/10/2023) pertaining to the new provisions on fixed-term contracts.
Note, as reported in the subject line, that these are "first indications."
It is considered useful to recall that the circular issued by the Ministry does not have the force of law, but guides the activities of Labor Inspectors.
The text shared by the Ministry implements a series of cross-references to the regulations governing fixed-term contracts, deeming it necessary to resort to this expedient in order to explain the way in which the reasons for the use of the reasons or the possible exclusion from the obligation of the same.
