Subject: Access to NASpI unemployment benefit in case of resignation by a father worker who has taken paternity leave


Following the entry into force, effective August 13, 2022, of Legislative Decree no. 105 of June 30, 2022, containing provisions aimed at improving work-life balance for parents and caregivers, the Inps intervened with its circular dated March 20, 2023, to provide administrative guidance regarding access to NASpI unemployment benefits in the event of voluntary resignation of a father worker who has taken paternity leave, as well as until the child is one year old.


Starting from the principle that female workers cannot be dismissed from the beginning of the pregnancy period until the end of the periods of interdiction from work, as well as until the child is one year old, Legislative Decree No. 105 of 2022 stipulated that:
