I construction sites are among the most dangerous work environments, where serious, sometimes fatal accidents occur every year. To increase the safety of workers and all professionals involved in construction sites, the government issued a Decree (DL 19/2024) which establishes the entry into force as of October 1, 2024 of some new obligations to strengthen the safety of workers: among them the points-based license on construction sites. To be precise, Article 27 of Legislative Decree No. 81/2008 has been replaced by the following:
"(Qualification system of enterprises and self-employed workers through credits).
- As of October 1, 2024 and upon the outcome of the integration of the portal referred to in Paragraph 9, enterprises and self-employed workers operating at temporary or mobile construction sites referred to in Article 89, Paragraph 1 (a) shall be required to possess the license referred to in this Article. The license is issued, in digital format, by the competent territorial headquarters of the National Labor Inspectorate subject to the possession of the following requirements by the legal head of the applicant enterprise or self-employed worker:
(a) Registration with the chamber of commerce industry and handicrafts;
(b) fulfillment by the employer, managers, supervisors and workers in the enterprise of the training obligations under Article 37;
(c) fulfillment by self-employed workers of the training obligations under this Decree;
(d) Possession of the valid single document of regularity of contribution (DURC);
(e) Possession of the Risk Assessment Document (DVR);
(f) possession of the Single Document of Fiscal Regularity (DURF)."
Ministerial Decree No. 132 of Sept. 18, 2024, defined the procedures for applying for a credit license, which is required to work within temporary and mobile construction sites. The entry into force of the credit license takes effect from October 1, 2024.
