Following the Decree-Law on Urgent Measures on the Containment and Management of the Epidemiological Emergency from COVID-19 and its implementing provisions -- aimed at the containment and management of the epidemiological emergency -- the main measures taken to address the situation from the point of view of employment and related tax compliance are reported.
Preliminarily, it is stated that the municipalities affected by the urgent measures to contain the infection are:
in the Lombardy Region: Bertonico; Casalpusterlengo; Castelgerundo; Castiglione D'Adda; Codogno; Fombio; Maleo; San Fiorano; Somaglia; Terranova dei Passerini.
In the Veneto Region: Vò.
These measures are valid immediately until Sunday, March 8, 2020, subject to further subsequent provisions.
STEPS TAKEN
Mode of work performance: agile work
For municipalities affected by the urgent measures, the agile working mode known as smart working is automatically applied to any employment relationship that does not require the necessary presence in the company, even in the absence of the stipulated individual agreements.
For all other municipalities, it will be necessary to enter into the agreement as stipulated in the relevant legislation. Specifically, the stipulation of the agreement between employer and employee will be required, which will need to be registered and uploaded within the Ministry of Labor website (Cliclavoro).
Protection in the workplace
The employer under the provisions of Article 2087 of the Civil Code is required to take measures to protect the physical integrity of employees, therefore, an analysis of procedures and measures related to the health and safety of workers is necessary.
