Subject: Elevation of parental leave allowance from 30% to 80% of pay for the maximum duration of one month and new event codes
In a recent circular, the Inps has dictated operational instructions for the elevation of parental leave allowance from 30 percent to 80 percent of pay for the maximum duration of one month and up to the sixth year of the child's life, a measure introduced by Law No. 197 of Dec. 29, 2023 (Budget Law 2023) in Article 1 paragraph 359.
The elevation of the allowance only affects employees, thus all other categories of workers are excluded.
Accordingly, if one parent is employed and the other parent is not, the month of parental leave compensated at 80 percent of pay accrues only to the employed parent.
One month is not added to the total number of months of parental leave: there is only an elevation of the allowance by only one month of the three due to each parent, which is not transferable to the other, provided that the month compensated at 80 percent of pay is taken within the six years of the child's life (or within the six years of entry into the family, in the case of adoption or foster care).
Inps points out that the month compensated at 80 percent of pay is only one for both parents and can be enjoyed in a split mode between them or by only one of them.
