News n.38/2022
In view of the general election on September 25, 2022, we think it is appropriate to summarize the obligations of the worker and companies.
Employees may be appointed to polling stations as:
Presiding officer
Secretary
Scrutineer/Scrutineer
List Representative
Workers engaged in election activities have the right to be absent from work for the entire period corresponding to the duration of voting and polling operations.
Days of absence will be considered days of work activity.
Under no circumstances may the employer prevent its employee from fulfilling this duty.
Participation in the polling station provides the following scheme for employees:
1) Days considered to be work days (Monday, or Saturday if considered work days by the applicable collective bargaining agreement) should be paid at the regular rate of pay, as if the employee had performed his/her usual work at the company;
2) Holidays or non-working days (usually Sundays but also Saturdays in the case of a short week) entitle the person to an additional share of pay over and above the regular pay, or to one or two days of compensatory rest.
