Decree Law No. 48/2023: Urgent measures for social inclusion and access to employment

Last May 4, it was published in Official Gazette No. 103 the so-called Labor Decree (Decree-Law No. 48/2023).

The decree took effect on May 5, 2023.


As might be expected, the measure is quite complex, having introduced a number of changes to measures already in place together with new ones.

Due to the body of the published text, and pending the desired clarification of the measures introduced, the following is a summary of some of the points of greatest interest to employers.


Security (Art. 14 -18):

Decree Law No. 48/2023 in Chapter II takes action on safety in the workplace, making amendments to Legislative Decree No. 81 of April 9, 2008.

In particular, the extension of the protection measures provided at construction sites also for self-employed workers, the obligation to update the DVR in the case of activation of school/work alternation paths with identification of those responsible for the apprenticeship path is provided. In addition, a Fund is established to support Families of student victims of labor.


An amendment is made to Article 25 paragraph 1 of Legislative Decree No. 81/2008. Subparagraph (e) provides that the competent physician "deliver to the worker, upon termination of employment, the health records in his possession (...) and provide him with information regarding the need for storage". With the Decree under comment, letter e-bis) is added, which provides that the competent doctor shall request from the worker, at the time of recruitment visits, the health records issued by the previous employer and take into account their contents for the purpose of formulating the judgment of suitability.
