On Dec. 28, 2024, Law No. 203 of Dec. 13, 2024, on the following was published in Gazzetta Official Gazette. "Provisions on labor matters" (so-called "Collegato Lavoro"), which will come into force on January 12, 2025.
The measure aims to simplify and correct various requirements related to the labor relationship, with particular reference to occupational health and safety regulations, social security regulations and labor contract regulations.
In Note No. 9740 dated Dec. 30, 2024, the National Labor Inspectorate provided initial guidance on the contents of the Law.
With this News we summarize the changes of most interest to private employers.
"Amendments to Legislative Decree No. 81 of April 09, 2008." - Occupational health and safety regulations (Art. 1)
(a) An annual report is to be prepared, by the Ministry
of Labor and to be forwarded to the Chambers, on the state of safety in the workplace, which should contain an indication of measures to improve safety conditions;
(b) As part of the health surveillance carried out by the competent physician.
the possibility of conducting preventive medical examinations to assess suitability for the specific job at the pre-employment stage is recognized;
(c) Following absences of more than 60 continuous days, it is the physician's
competent to consider whether to conduct medical examinations prior to the date of return to work;
