Law No. 14 of February 24, 2023, of "Conversion into law, with amendments, of Decree-Law No. 198 of December 29, 2022, containing urgent provisions on legislative deadlines. Extension of deadlines for the exercise of legislative proxies" (the so-called Milleproroghe Decree) provided for important changes affecting labor, we mention those of most interest:
Smart Working
The possibility for so-called fragile workers to perform work in agile mode, including by being assigned to a different task included in the same category or area of classification, as defined by current collective bargaining agreements, without any reduction in their current pay, has been extended to June 30, 2023.
This possibility has also been extended to employed parents in the private sector who have at least one child under the age of 14, provided that there is no other parent in the household who is a beneficiary of income support tools in the event of suspension or termination of employment or that there is no non-working parent, making it possible by June 30, 2023 to perform work in agile mode, even in the absence of individual agreements, subject to compliance with the disclosure requirements of Articles 18 to 23 of Law No. 81/2017, and provided that this mode is compatible with the characteristics of the work performance.
Reorganization of existing disability provisions.
The deadline for the adoption of one or more legislative decrees for the revision and reorganization of existing disability provisions under Law No. 227 of December 22, 2021, was extended to March 15, 2024.
