Smart working adoption: new ways of communication

With the conversion into Law of Decree No. 73/2022 (the so-called Simplification Decree) into law, important changes were made to the way in which services rendered in smart working are reported.


Specifically, the new Article 41-bis makes changes to Article 23 of Law 81/2017.

Specifically, as a result of these changes, the new paragraph 1 of Article 23 stipulates that, as of September 1, 2022, the employer shall electronically notify the Ministry of Labor of the names of workers and the date of commencement and termination of agile work services, in accordance with the procedures identified by decree of the Minister of Labor and Social Policy.


Last August 22, the relevant Ministry issued Ministerial Decree No. 149/2022, which identifies the new methods of communication, to be made electronically, of agile work.

The same data on agile work performance will be made available to the National Institute for Workers' Compensation Insurance in the manner prescribed by the Digital Administration Code.
